Uploading images at commons seems bo be half broken. There are two different file upload dialogues, and you seem to get one at random for each page load.

I just tested right now, and if I click the "entirely my own work" link at 
  http://commons.wikimedia.org/wiki/Commons:Upload
then I get version 1. But if I manually enter
   http://commons.wikimedia.org/w/index.php?title=Special:Upload&uselang=ownwork
then I get version 2.

But it is not entirely consistent. A few times where I clicked the "entirely my own work" link, then I got version 2.

Worse, sometimes it seems that the POST input from one of them is received by the logic from the other one, leading to a nonsense error about "license not specified" when submitting from version 1.

If you are using some kind of load balancing, then I am in Europe. Resolving commons.wikimedia.org gives the following:
t@h ~> host commons.wikimedia.org
commons.wikimedia.org is an alias for text.wikimedia.org.
text.wikimedia.org is an alias for text.esams.wikimedia.org.
text.esams.wikimedia.org has address 91.198.174.232

You should get version 2 in both cases. They're the same form. Version 1 is the plain form as implemented by the MediaWiki software; version 2 is the same form rewritten by some client-side JavaScript.

If you're not always getting version 2, this might indicate some load order problem with the JavaScripts on Chrome.

Please check the full URL in the browser's address bar the next time you get the plain version (version 1) and report it here. If it ends with "&uploadformstyle=plain", that's an indication of a JavaScript problem. Check the browser's error console for any messages and report them here, too.

What version of Chrome are you using? And what Operating System? Also, what skin is this? Vector or monobook?

I just tested, and I got version 1 every time except for the first, so easy to reproduce. Note that I still have to access the page from "upload file"->"own work" to get version 1.

The full url is http://commons.wikimedia.org/w/index.php?title=Special:Upload&uselang=ownwork

I get a single error from the chrome error console:
"<big> misnested or not properly closed.  Cloning <big> in order to preserve the styles applied by it."

My browser is "5.0.375.99 (51029) Built on Debian unstable, running on Debian squeeze/sid".

My skin is Vector.

I prefer version 1 to version 2, btw. When uploading a series of images then you can paste in all the fields at one go in version 1. Is there a way to make it default to version 1?

Click "basic upload form" or bookmark https://commons.wikimedia.org/w/index.php?title=Special:Upload&uploadformstyle=basic
