Actual behavior:

If a certain image description page is protected against creation [create=sysop], any normal user can still upload an image under the same name.

Desired behavior:

If a certain image description page is protected against creation, only users with the appropriate permission (e.g. sysop) should be able to upload an image under the same name.

Please fix this. Thanks.

Yes, someone has to scap to SVN. Which is done periodically.
